These Terms of Use ("Terms") govern your access to and use of the UP2U Co-Pilot mobile application and this website (together, the "Services"), provided by UP2U Solutions Academy ("UP2U," "we," "us," or "our"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Who May Use the Services
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services. By using them, you represent that you meet this requirement and that the information you provide is accurate.
2. Not Professional Advice
The UP2U Co-Pilot is an educational and decision-support tool. It does not provide medical, mental-health, legal, financial, or other professional advice, and it is not a substitute for the judgment of a qualified professional. You are solely responsible for the decisions you make. If you are in crisis or need professional guidance, contact a licensed provider or your local emergency services. Nothing the app outputs — including any GO, HOLD, or NO-GO verdict — is a directive; it is informational support for your own decision.
3. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at info@up2usa.com of any unauthorized use.
4. Subscriptions, Billing, and Renewal
The app is free to download. Certain premium features require an auto-renewing subscription purchased through the Apple App Store. Payment is charged to your Apple ID at confirmation of purchase. Your subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours prior to the end of the period. You can manage and cancel subscriptions in your App Store account settings. Refunds, where applicable, are handled by Apple under Apple's terms.
5. Acceptable Use
You agree not to: use the Services for any unlawful purpose; reverse engineer, copy, or resell the Services; interfere with or disrupt the Services; or use the Services to harm yourself or others. We may suspend or terminate access for conduct that violates these Terms.
6. Intellectual Property
The Services and all related materials and trademarks — including UP2U's Flight Plan method and its original training, audio, and software — are owned by UP2U Solutions Academy or its licensors and are protected by intellectual-property laws. The C.A.R.E. aeronautical decision-making framework originates with the U.S. Federal Aviation Administration and is in the public domain; UP2U claims no ownership of the underlying acronym and offers only its own application of it. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use. The decision entries and notes you create remain yours.
7. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that any outcome will result from their use.
8. Limitation of Liability
To the fullest extent permitted by law, UP2U and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the Services or from any decision you make. Our total liability for any claim relating to the Services will not exceed the amount you paid us in the twelve months before the claim.
9. Indemnification
You agree to indemnify and hold harmless UP2U from any claims, damages, or expenses arising out of your use of the Services or your violation of these Terms.
10. Changes to the Services or Terms
We may modify or discontinue the Services, and we may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above; continued use after changes means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules. Apple is not a party to these Terms and is not responsible for the Services.
